Yes. Since 1994, the right for parents to home educate their children was legalised in South Africa through the adoption of the new constitution. In 1996 this right was acknowledged by the introduction of art. 51 of the SA Schools act which explicitly states that parents may register their children for education at home. There are however legal issues with the registration conditions causing many parents being unwilling to register.
🌿 Homeschooling under BELA: Get clarity before you decide
Section 51 of the BELA Act — which governs home education — raises important concerns for homeschooling families. Because it treats families like schools, it is not consistent with the Constitution, which protects parents’ freedom to guide and direct their children’s education.
While the Act remains in force, parents can’t wait for departments to adjust course. For some families, especially those facing outside pressure, the practical benefits of registration may outweigh disadvantages.z
